Administrative Deviations
The Zoning Administrator is authorized to grant administrative deviations to reduce minimum lot area and required yards (setbacks); minimum number of required off-street parking spaces; minimum landscaping requirements; maximum lot coverage; areas of situational compatibility buffer requirements, set forth in Section 656.399.19; required driveway/aisle widths; to increase the allowable maximum height of structures, including fences; and to increase the maximum number of off-street parking spaces.
Upon filing an application for Administrative Deviation, staff reports and recommendations are issued by Current Planning Division pursuant to criteria in Section 656.109(h). Recommendations by staff are presented to the Zoning Administrator at regularly scheduled public hearing dates. After the hearing, the Zoning Administrator prepares a written order approving or denying the application for an administrative deviation. The written order shall be executed by the Zoning Administrator and the Director within twenty-one (21) days of the hearing. The written order granting or denying the administrative deviation, executed by both the Zoning Administrator and the Director, shall be effective fifteen (15) days after the execution thereof, unless appealed pursuant to the provisions of Section 656.109(j).
